IP MATTERS IN CHINA

1. The Intellectual Property Court notified that since the outbreak of COVID-19, the Beijing Intellectual Property Court adjusted the case registration work method during this period, according to the notice issued by the Beijing Municipal High People's Court in January 2020. The parties can file cases online through information platforms such as the Beijing Court Trial Information Network (http://www.bjcourt.gov.cn). If it is inconvenient to file a case online, it is available to file the case by mail.

According to the statistics of the Beijing Intellectual Property Court, from February 3 to February 28, a total of 1,560 postal mail cases were received, an increase of 514% over the same period last year; 1,506 postal mail cases were reviewed, an increase of 723% over the same period last year; 395 cases were filed.

 


2. The ministry of patent reexamination and invalidation of China announced that, in terms of the examination cycle, the average closing cycle of patent reexamination cases is 11.8 months. The period for the review and conclusion of invalidation cases has declined steadily, averaging 5 months. It is worth mentioning that 90 patent reexamination cases were concluded through the priority review procedure, with an average period of 6.2 months, and 145 invalidation cases with an average period of 4.8 months.

3. The state intellectual property office of the People's Republic of China has released the key tasks for the year 2020 and determined to continue to improve the quality and efficiency of the intellectual property inspection. By the end of the year 2020, the period of examination of high-value patents will be reduced to less than 16 months, and the average period of examination of trademark registration will be reduced to less than 4 months, to improve the examination quality of utility models and designs, and ensure that the user satisfaction index of the quality of patent examination is within a satisfactory range. New progress in the intelligent upgrading of patent examination and retrieval systems will be made. Modes of centralized review, priority review, patent review, and delayed review will be made to meet diverse needs. A long-term mechanism to fight against abnormal patent application and trademark registration and hoarding will be performed. Cancellation subsidies and awards for utility models, designs and trademark registration will be encouraged.

4. The National Intellectual Property Administration has decided to publish decisions of opposition on the website from January 1, 2020.
