On October 30, 2024, China’s National Intellectual Property Administration (CNIPA) published the Report on the Development of the Construction of an Intellectual Property Power (2024) (知识产权强国建设发展报告(2024年)), which reports on the status of the Guidelines for Building a Powerful Country with Intellectual Property Rights (2021-2035). The Report was released by the Office of the National Intellectual Property Power Construction Inter-ministerial Joint Conference.
Some of the goals from the Report include:
Improve the intellectual property legal system around supporting high-level scientific and technological self-reliance and promoting the development of new quality productivity.
Accelerate the new round of revision of the Trademark Law and the special legislation research on geographical indications,
carry out the revision of the integrated circuit layout design protection regulations, and
accelerate the completion of the revision of the Copyright Law Implementation Regulations and other laws and regulations.
Improve the punitive compensation system.
Crack down on malicious intellectual property litigation.
Strengthen guidance on dealing with overseas intellectual property disputes.
Some statistics from the Report follow.
the average examination period for invention patents was shortened to 16 months;
the average examination period for trademark registration was stabilized at 4 months;
the registration period for copyright of works was shortened to 25 working days;
the average registration period for software copyright was stabilized at 30 working days;
In 2023, 829 patent agencies were approved to be established throughout the year, with nearly 13,000 new patent agent qualifications obtained;
Five foreign patent agencies were approved to establish permanent representative offices in China;
In 2023, courts at all levels adjudicated 490,000 first-instance intellectual property cases;
Punitive damages in 319 civil infringement cases of intellectual property rights were awarded (up by 1.2 times), totaling 1.16 billion RMB (up by 3.5 times);
30,700 criminal intellectual property cases were prosecuted;
Customs seized 62,000 batches of suspected infringing imports and exports;
The number of high-value patents per 10,000 people will reached 11.8 in 2023 and is expected to hit 12 in 2025;
