Wuhan strengthens e-commerce intellectual property protection

In order to strengthen the protection of intellectual property rights in e-commerce, Wuhan Intellectual Property Office has recently researched and issued the "Implementation Opinions on Strengthening the Strict Implementation of Subject Responsibility Supervision and Inspection on E-commerce Platforms" (hereinafter referred to as "Implementation Opinions"), which will establish and improve intellectual property protection The rules are included in the inspection and disposal items, the supervision and management responsibilities of e-commerce platform operators are performed in accordance with the law, the law enforcement inspection is carried out in accordance with the work specifications, the violation of laws and regulations is handled, and the network market environment is purified.

 

The "Implementation Opinions" adhere to the principles of legal inspection and regulation, inclusive and prudent supervision, and government-enterprise collaboration and co-governance in accordance with the E-commerce Law and relevant laws and regulations, and clarify that the administrative law enforcement personnel shall publicize the license information to e-commerce platform operators and establish a sound Eight inspections and disposals including the credit evaluation system, the establishment and improvement of intellectual property protection rules, and the establishment of a city-wide e-commerce platform and key e-commerce enterprise liaison system. According to the "Implementation Opinions", the intellectual property protection system of e-commerce platform operators shall include, but is not limited to, the review of operating activities involving intellectual property rights by the operators on the platform, the establishment and management of the intellectual property complaint channels for the operators on the platform, and the platform operators Rules for handling intellectual property complaints, promptly publicizing the received complaints and handling results, and keeping and managing documents in the complaint handling process.

 

The "Implementation Opinions" require that e-commerce platform operators set up IP complaint channels, which should include but are not limited to telephone channels, instant messaging channels, and IP complaint system channels, etc.; a dedicated person should be designated to be responsible for IP review, complaint acceptance, and IP rights Handling of human rights protection matters. At the same time, based on the principle of strict protection and fast protection, the "Implementation Opinions" also clearly stipulated the time limit for e-commerce platform operators to handle complaints about intellectual property rights.
